SAWC upcoming events

The San Augustin Water Coalition will have a Board of Directors meeting on January 13th. At 6:00 p.m. at the Datil Baptist Church.

The public is invited. Agenda items will include an overview of the SAWC presentation to the Interim Water and Natural Resources Committee of the NM Legislature on December 2nd., a report on the NM Water Dialogue annual meeting (see next item), and planning the SAWC annual meeting.

The NM Water Dialogue will host its 21st annual meeting on January 8th at the Indian Pueblo Cultural Affairs Center in Albuquerque. Please go to their website for further information. Everyone is encouraged to attend, and it will cover a wide array of water issues in New Mexico.

San Augustin Water Grab Appeals Process

From SAWC attorney Bruce Frederick re:  San Augustin water grab appeals process.

The hearing, if there is one, will be in Santa Fe or ABQ at the Court of Appeals.

Two caveats:   (1) The Court of Appeals often decides cased based on the written briefs without any oral argument. And (2), if there is oral argument, it won't be scheduled for months or even more than a year from now.

The appellate process will likely consist generally of the following steps in this appeal:

• Notice of Appeal
• Docketing Statement
• Calendaring
• Filing of Transcripts from Lower Court
• Brief in Chief by Appellant
• Response by Appellee (us)
• Reply Brief by Appellant
• Oral Argument (at the option of the Court)
• Decision

 We are not yet at the "Docketing Statement" stage.

San Augustin Water Grab Court Date Set

A hearing on the Motion for Summary Judgement for the Augustin Plains Ranch LLC water grab has been set for Wednesday September 19, 2012 at 11 a.m. at the Catron County Courthouse in Reserve (subject to date/time change).

The appeal case should be starting within the next couple of weeks.  There are no deadlines pending right now.

The court case should be a condensed version of the OSE case�we will file a motion to dismiss; they will respond, we will reply.  I hope we can wrap it up in less than a year.
